       Commissioner Lee moved the following:
       
    1         CRC Amendment (with title amendment)

    3         Delete line 10
    4  and insert:
    5         Sections 3 and 4 of Article III of the State Constitution
    6  are

    9  insert:
   10         SECTION 4. Quorum and procedure.—
   11         (a) A majority of the membership of each house shall
   12  constitute a quorum, but a smaller number may adjourn from day
   13  to day and compel the presence of absent members in such manner
   14  and under such penalties as it may prescribe. Each house shall
   15  determine its rules of procedure.
   16         (b) Sessions of each house shall be public; except sessions
   17  of the senate when considering appointment to or removal from
   18  public office may be closed.
   19         (c) Each house shall keep and publish a journal of its
   20  proceedings; and upon the request of five members present, the
   21  vote of each member voting on any question shall be entered on
   22  the journal. In any legislative committee, or subcommittee,
   23  joint committee, or conference committee, a quorum shall be
   24  required and the vote of each member voting on the final passage
   25  of any legislation pending before the committee, and upon the
   26  request of any two members of the committee, or subcommittee,
   27  joint committee, or conference committee, the vote of each
   28  member on any other question, shall be recorded.
   29         (d) Each house may punish a member for contempt or
   30  disorderly conduct and, by a two-thirds vote of its membership,
   31  may expel a member.
   32         (e) The rules of procedure of each house shall provide that
   33  all legislative committee and subcommittee meetings of each
   34  house, and joint conference committee meetings, shall be open
   35  and noticed to the public. The rules of procedure of each house
   36  shall further provide that all prearranged gatherings, between
   37  more than two members of the legislature, or between the
   38  governor, the president of the senate, or the speaker of the
   39  house of representatives, the purpose of which is to agree upon
   40  formal legislative action that will be taken at a subsequent
   41  time, or at which formal legislative action is taken, regarding
   42  pending legislation or amendments, shall be reasonably open to
   43  the public. All open meetings shall be subject to order and
   44  decorum. This section shall be implemented and defined by the
   45  rules of each house, and such rules shall control admission to
   46  the floor of each legislative chamber and may, where reasonably
   47  necessary for security purposes or to protect a witness
   48  appearing before a committee, provide for the closure of
   49  committee meetings. Each house shall be the sole judge for the
   50  interpretation, implementation, and enforcement of this section.

   53  And the title is amended as follows:
   54         Delete lines 2 - 5
   55  and insert:
   56         Sections 3 and 4 of Article III of the State
   57         Constitution to provide that the Legislature convene
   58         for regular session on the second Tuesday after the
   59         first Monday in January of each even-numbered year, to
   60         require a quorum in any legislative committee,
   61         subcommittee, joint committee, or conference
   62         committee, and to specify that provisions governing
   63         the recording of votes apply to joint committees and
   64         conference committees.
