ARTICLE II: GENERAL PROVISIONS, Section 6. Enemy attack.

SECTION 6.Enemy attack.

In periods of emergency resulting from enemy attack the legislature shall have power to provide for prompt and temporary succession to the powers and duties of all public offices the incumbents of which may become unavailable to execute the functions of their offices, and to adopt such other measures as may be necessary and appropriate to insure the continuity of governmental operations during the emergency. In exercising these powers, the legislature may depart from other requirements of this constitution, but only to the extent necessary to meet the emergency.

ARTICLE II: GENERAL PROVISIONS, New Section.

(a) The State shall maintain and provide for a well regulated Florida National Guard. Every County shall maintain and provide for a well regulated defense force.  

(b)  Every county defense force shall hold monthly training in basic combat and military disciplines. The State shall hold quarterly training for all members of the several Countries Defense Forces as one Florida Defense Force.  

(c)  The Florida National Guard and the Florida Defense Force shall both be compensated. Florida National Guard, in times of State or Federal declared emergency, may be called forth to maintain civil order, or in times of declared War or in case of invasion would become part of  the Army of the United States, and at all times be ready for the common defense of the several States. However, neither the Florida National Guard nor the Armed Forces of the United States shall have or exercise the power to enforce Florida law.  

(d)  Florida Defense Force in times of State or County declared emergency may be called forth to maintain civil order and may have the power to enforce laws. Florida Defense Force may never be called forth for Federal Service.
