ARTICLE IV: EXECUTIVE, Section 9. Fish and wildlife conservation commission.

(a) CREATION. There shall be a fish and wildlife conservation commission, composed of seven members elected for staggered terms of six years. No member of the commission shall serve more than twelve years in any period of eighteen years.appointed by the governor, subject to confirmation by the senate for staggered terms of five years. The state shall be divided into seven districts of equal population and contiguous territory; and one member of the commission shall be elected from each district by the electors thereof. The members shall elect from their number a chairperson who shall preside over the commission for three years.
(b) POWERS AND DUTIES.
1. The commission shall exercise the regulatory and executive powers of the state with respect to wild animal life and fresh water aquatic life, and shall also exercise regulatory and executive powers of the state with respect to marine life, except that all license fees for taking wild animal life, fresh water aquatic life, and marine life and penalties for violating regulations of the commission shall be prescribed by general law.
2. The commission shall establish procedures to ensure adequate due process in the exercise of its regulatory and executive functions.
3. The legislature may enact laws in aid of the commission, not inconsistent with this section, except that there shall be no special law or general law of local application pertaining to hunting or fishing.
4. The commission's exercise of executive powers in the area of planning, budgeting, personnel management, and purchasing shall be as provided by law.
5. Revenue derived from license fees for the taking of wild animal life and fresh water aquatic life shall be appropriated to the commission by the legislature for the purposes of management, protection, and conservation of wild animal life and fresh water aquatic life. Revenue derived from license fees relating to marine life shall be appropriated by the legislature for the purposes of management, protection, and conservation of marine life as provided by law.
6. The commission shall not be a unit of any other state agency and shall have its own staff, which includes management, research, and enforcement.
7. Unless provided by general law, the commission shall have no authority to regulate matters relating to air and water pollution.
ARTICLE IV: EXECUTIVE, Section 11. Department of Veterans Affairs.
The legislature, by general law, may provide for the establishment of the Department of Veterans Affairs.
ARTICLE IV: EXECUTIVE, Section 12. Department of Elderly Affairs.
The legislature may create a Department of Elderly Affairs and prescribe its duties. The provisions governing the administration of the department must comply with Section 6 of Article IV of the State Constitution.
ARTICLE IX: EDUCATION, Section 2. State board of education.

(a) CREATION. The state board of education shall be a body corporate and have such supervision of the system of free public education as is provided by law. The state board of education shall consist of seven members appointed by the governor to staggered 4-year terms, subject to confirmation by the senate. The state board of education shall appoint the commissioner of education.
(b) COMPOSITION. The state board of education shall consist of seven members elected for staggered terms of four years. No member of the board shall serve more than eight years in any period of twelve years. The state shall be divided into seven districts of equal population and contiguous territory; and one member of the board shall be elected from each district by the electors thereof.
(c) SUPERINTENDENT OF EDUCATION. The state board of education shall appoint the superintendent of education, whose powers, duties, and qualifications shall be provided by law.
ARTICLE X: MISCELLANEOUS, New Section.
(a) COMMISSION CREATED.
1. There shall be a public service commission which shall consist of 5 members, who shall be elected for staggered terms of 6 years. No member of the commission shall serve more than twelve years in any period of eighteen years.
2. The state shall be divided into 5 districts of equal population and contiguous territory; and one member of the commission shall be elected from each district by the electors thereof.
3. The members shall elect from their number a chairperson who shall preside over the commission for a term of 3 years.
(b) POWERS AND DUTIES. The public service commission shall have general jurisdiction over:
1. Contract and common carriers engaged in the transportation of persons and property, excluding air carriers.
2. Telecommunications companies engaged in the furnishing of telecommunications services as provided by law.
3. Pipeline utilities engaged in the transportation of gas, oil, coal, and water.
4. Electric utilities engaged in the generation and distribution of light, heat, or power.
5. Gas utilities engaged in the distribution of natural, synthetic, or artificial gas.
6. All heating utilities engaged in the distribution of heat.
7. Warehouse companies engaged in the marketing, storage, or handling of agricultural products.
8. All other public utilities engaged in business in this state or in any county, city, municipality, or other political subdivision of the state.
9. Additional jurisdiction, powers, and duties for the commission may be provided by law.
