PUB 700455: Florida Voter’s Right to Repeal Unjust State Laws via a State Referendum by Nathan DiPietro

ARTICLE III: LEGISLATURE, New Section.

Catchline: Florida Voter’s Right to a Repeal Referendum

            (a) The voters of Florida shall have the right, via a state-wide referendum, to repeal laws that are passed by the State Legislature that they deem to be against the public’s best interest. The question on the ballot shall ask if a given ordinance (which shall be summarized on the ballot as determined by law) shall be repealed. 55% yes vote shall be required to repeal the law. If repealed, the law shall become ineffective on January 1st following that election. The scope of each repeal referendum shall be limited to only one law that was passed by the legislature.

            (b) The means for putting the law on the ballot shall be the same as for proposing an amendment to this Constitution except that the needed number of signatures to be presented with the petition shall be equal to the number of electors in each of one half of the congressional districts of the state, and of the state as a whole, equal to six percent of the votes cast in each of such districts respectively and in the state as a whole in the last preceding election in which the presidential electors were chosen.
