ARTICLE X: MISCELLANEOUS, New Section.

Catchline: Charges based on nonoperational property of a utility prohibited

 

  1.  Before any property is fully operational and used as the end product or used to deliver a service for which a utility’s ratepayers subscribe, a state, regional, county, municipal, or other locally regulated utility shall not make any charge to or demand of ratepayers for costs and expenses for developing, relocating, siting, licensing, design, construction, taxes on, or financing of that property. Charges made or demanded contrary to this clause are unjust and unreasonable, and are prohibited.
  2. The legislature shall enforce this section by legislation.
